Terms of Service
The agreement for using Gardien.
Plain terms for accounts, billing, acceptable use, and liability. If you have a separate signed agreement with Gardien, that agreement controls where it conflicts with these terms.

1. Agreement & eligibility
These Terms are an agreement between you and the individual operator of Gardien, an owner-operated project based in California, United States that is not yet a separately registered legal entity. The operator's complete legal identity will be published before paid launch. You must be at least 18 and able to form a contract. If you use Gardien for an organization, you confirm you are authorized to bind it, and "you" means that organization.
2. The service
Gardien provides agent identity (passports), a website checkpoint/verifier, policy and verification-level enforcement, revocation, website and agent analytics, and audit logs. Features may differ by plan and change during early access.
3. Accounts
You are responsible for your account, credentials, and everything done under it. Keep sign-in secure, keep contact details current, and tell us promptly of any unauthorized use.
4. Plans, fees & billing
Businesses may use the checkpoint and website analytics free during early access. Paid plans are not currently enabled. Before paid launch, the checkout will show the applicable price, billing period, taxes, processor, and renewal terms for your review before purchase.
5. Renewal & cancellation
When paid subscriptions launch, the purchase flow will state whether a plan renews automatically and how to cancel it. No subscription is created or renewed under these Terms until Gardien enables paid checkout and you expressly complete that purchase.
6. Refunds
Refund and proration terms will be shown before paid checkout launches and will comply with applicable law. Gardien does not currently collect subscription fees.
7. Acceptable use
You must follow the Acceptable Use Policy. You may not use Gardien for malware, credential theft, unauthorized access, deception, unlawful surveillance or discrimination, or to bypass security controls.
8. Customer responsibilities
You configure your own policies and verification requirements, protect your credentials, validate sensitive actions server-side, obtain any consents your own users require, and comply with the laws that apply to your workflows, users, and data.
9. No behavior guarantee
A verified identity means an agent presented a recognized passport at a given verification level. It does not guarantee the agent will behave correctly, safely, or in your interest. Verifier decisions are inputs to your own controls, not a substitute for them.
10. Intellectual property
Gardien and its software, brand, and content are owned by Gardien. You receive a limited, revocable, non-transferable right to use the service under these Terms. You retain ownership of your data and grant Gardien the rights needed to operate the service for you.
11. Availability & changes
The service is provided during active development. We may change, suspend, or discontinue features, and may limit or suspend use that threatens security, reliability, or other customers.
12. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, Gardien is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Gardien's total liability for any claim is capped at the greater of the fees you paid in the 12 months before the claim or US$100.
14. Indemnification
You will defend and indemnify Gardien against third-party claims arising from your use of the service, your data, your agents, or your breach of these Terms, except to the extent caused by Gardien.
15. Termination
You may stop using Gardien and close your account anytime. We may suspend or terminate access for breach, security risk, or non-payment. On termination, your right to use the service ends and we handle your data as described in the Privacy Policy.
16. Governing law & disputes
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules. Subject to rights that cannot legally be waived, disputes will be brought in the state or federal courts serving Los Angeles County, California. Nothing in this choice of law removes consumer, privacy, or other rights that cannot legally be waived in your location.
17. Changes to these Terms
We may update these Terms. Material changes will be posted here with a new effective date and, where appropriate, notified to you. Continued use after changes take effect means you accept them.

Legal and account notices may be sent through the contact page or to admin.gardien.io@gmail.com. Gardien is not yet a separately registered legal entity; the operator's verified legal name and any legally required business notice details will be published before paid launch.
